Swaraj India today filed an appeal before the Division Bench of the Delhi High Court, challenging the Order dated 29th March 2017 passed by a Single Judge of the High Court, turning down the prayer of Swaraj India to have a common symbol for the MCD Elections. On mentioning by counsel on behalf of Swaraj India, the Hon’ble Court has directed listing the Appeal for hearing on 31st March 2017. Swaraj India had urged before the State Election Commission and the Single Judge of the Delhi High Court that common symbol should be allotted to all registered unrecognised parties so that a level playing field is created in the elections.
It is noteworthy that the Election Commission of India has created such level playing field by allowing common symbol in the case of Assembly and Parliamentary elections.It must be noted that in 2013, the Election Commission of India allowed common symbol for a registered political parties contesting it’s first election. But the Delhi Government didn’t move the amendments proposed by the State election commission consequentially the State election commission denied Swaraj India’s request to have a common symbol. This, despite the fact that the Aam Aadmi Party was also allotted a common symbol for 2013 assembly elections in Delhi. The State election Commission of Delhi had also proposed to the Delhi government for incorporating changes to make the State Election Commission’s rules in line with the rules of the Election Commission of India. But the Aam Aadmi Party government chose to just sit on the proposal for 2 years and maliciously blocked the proposal. Swaraj India is determined to fight this injustice and to create a level field for all players in order to ensure fair elections.
